Hurry up. For parents who want to take advantage of home education at the beginning of the next school year, three months in advance is crucial. Following the vote on the Separatism Act last summer, implementing decrees published in February stipulate that an application for prior authorization, which now replaces a simple declaration, must be sent from 1 January.ehm March to 31 May so that the child can be educated at home at the beginning of the next school year. Clarifications were also provided regarding the documents to be provided in support of the application.
Four irrevocable patterns
In particular, parents can rely on four grounds in support of their application: the child’s state of health or disability; performing intensive sports or artistic activities; family homelessness in France or geographical distance from any public school; the existence of a child-specific situation motivating the educational project.
The fruit of opposition to the government’s plan to ban home education, this fourth reason, the most open, should allow parents’ applications for permits to be largely satisfied. The Constitutional Council indicated that, in setting that criterion, the legislature intended to entrust the administration with the task of verifying that “the family education plan contains the basic elements of education and pedagogy adapted to the child’s abilities and pace”; and that “the person responsible for teaching” is able to enable the child to acquire a common base of knowledge, skills and culture “. Parents’ applications for their child (ren) must be addressed to the Academic Director of the National Education Services (DASEN), a representative of the Ministry in the field.
What documents to provide?
The February decrees also specify the list of documents that parents must attach to the application. Some of them are common for four reasons: the application form for authorization prepared by the Ministry of National Education; a document confirming the identity of the child, the identity of the parents, their place of residence and the identity of the person responsible for the child’s instructions, if they are not parents.
Additional documents specific to each reason are added: a medical certificate less than one year old in a sealed envelope confirming the child’s pathology if the application is motivated by the child’s state of health; a medical certificate in a sealed envelope or a decision of the Commission on the Rights and Autonomy of Persons with Disabilities concerning the child’s education, if the application is motivated by the child’s disability; a certificate of registration with a sports or arts organization, if the application is based on this reason, as well as a presentation of the child’s time organization, obligations and restrictions, which means that he or she cannot regularly visit a public or private establishment; “Any useful document” justifying the child’s inability to visit a public or private establishment on a regular basis if the request is motivated by the homelessness of the parents in France; as well as “any useful document” determining the geographical distance from any public school when the application is made on this basis.
How to justify the “child situation”?
For the last irrevocable reason (“the existence of a child-specific situation motivating the educational project”), parents must not give any specific justification for the reason given, but simply submit a substantiated “educational project” for their child. According to the decree, therefore, in support of their application for a permit, they must provide a “written presentation of the educational project, which includes the basic elements of teaching and pedagogy adapted to the child’s abilities and pace”.
This will include: “1 / A description of the educational approach and methods implemented to enable the child to acquire knowledge and skills in each area of preparation of a common core of knowledge, skills and culture; 2 / used resources and educational materials; 3 / organization of the child’s time (rhythm and duration of activities); 4 / If necessary, the identity of any distance learning organization participating in the child’s education and a description of the content of his / her contribution “. In addition, the decrees require parents to provide “all useful documents justifying the availability of the person or persons responsible for the child’s instruction” (whether one of the parents or a third party). , a copy of the graduation diploma, or its equivalent, of the person who will teach the child, as well as a solemn declaration that the person who will teach the child will do so in particular in French.
In the event that a document is missing upon receipt of the application, the report shall set a time limit for the delivery of the missing documents “which shall in no case exceed 15 days”. A short deadline that encourages parents to do their best to provide a complete set for the first time. If this is carefully completed, the report will have no means of rejecting the application for a permit on this fourth ground.
For parents who want to take advantage of home education at the beginning of the new school year, there are two exceptions to the three – month period from 1.ehm March to 31 May. In particular, the decrees state that an authorization may be requested “but” outside this period “for reasons which arose after that period”. However, it can then only apply to the first three reasons (child’s health or handicap, intensive sports or artistic activities, geographical roaming or geographical distance from any public school).
In the case of the fourth irrevocable reason (“existence of a child-specific situation motivating the educational project), the application will not be processed for more than three months. In addition, if parents make a late application for the first three reasons, they must provide “any evidence that the reasons for the request did not appear until after the deadline” from 1 January.ehm March to 31 May. Suffice it to say that even in this case, parents are interested in not relying too much on exceptions and trying to submit a complete application without delay.
Rights under the law for certain children
The fruit of the opposition, prompted by the government’s plan to ban home education, another exception applies to children who are already studying at home in the school year 2021-2022. For those, the authorization is “granted by law” for the school years 2022-2023 and 2023-2024, states the law on separatism. For this, it is only necessary that the results of the annual inspection carried out by the Deputy Minister of National Education be assessed as “satisfactory”.
However, this exception only applies to children who are already being educated at home. Parents who would already practice it for one of their children in 2021-2022 and would like to use it for another of their children in the school year 2022-2023 will have to go through the registration procedure for the other. prior authorization opened from 1ehm March to 31 May.
